A RESOLUTION OF THE CITY OF HEATH, TEXAS, DECLARING ELECTED TO THE OFFICE OF MAYOR, CITY COUNCIL PLACE 3 AND CITY COUNCIL PLACE 5 THE UNOPPOSED CANDIDATES FOR ELECTION TO THOSE OFFICES; PROVIDING THAT SUCH ELECTION SHALL BE EFFECTIVE AS OF MAY 8, 2010, AND THAT SUCH CANDIDATES SHALL TAKE THEIR OFFICE AS PROVIDED FOR BY LAW; PROVIDING THAT THE MAY 8, 2010, GENERAL ELECTION SHALL NOT BE HELD; PROVIDING THAT A COPY OF THIS RESOLUTION SHALL BE POSTED ON ELECTION DAY AT EACH POLLING PLACE THAT WOULD HAVE BEEN USED IN THE ELECTION; PROVIDING AN EFFECTIVE DATE.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HEATH, TEXAS:

Section 1. The City of Heath hereby cancels the election scheduled to be held on May 8, 2010, in accordance with Section 2.053(a) of the Texas Election Code. The following candidates have been certified as unopposed and are hereby elected as follows:

Mayor - John Ratcliffe
Council Member Place 3 - Julianna Zurek
Council Member Place 5 - Lorne Liechty
       
Section 2. Such election shall be effective as of May 8, 2010. The elected candidates shall take their office in accordance with law, and a certificate of election shall be issued to each candidate in the same manner as provided for a candidate elected at a general election.

Section 3. The May 8, 2010 General Election shall not be held.

Section 4. A true and correct copy of this Resolution shall be posted on May 8, 2010 by the City Secretary at each polling place that would have been used in the general election.

Section 5. This Resolution shall be in full force and effect from and after its passage.
